1. Scope
This Privacy Policy applies to Personal Information that Company collects, uses, and shares when you:
- access or use vertixiq.com or the Services
- create or manage an account with us
- subscribe to any paid Service tier
- submit content to the Services for analysis or processing
- communicate with us by any written, electronic, or oral means
2. Definitions
“Personal Information” means information that identifies, relates to, describes, or could reasonably be used to identify an individual person, including name, email address, phone number, and associated account information. Personal Information does not include aggregated, anonymized, or de-identified data that cannot reasonably be used to identify an individual.
“Subscriber Content” means prompts, inputs, submissions, and other content provided by or on behalf of a Subscriber to the Services, but does not include generated outputs once delivered through the Services unless expressly retained by Company.
“Operational Metadata” means account information, billing records, usage logs, telemetry, security records, diagnostic data, and other technical or administrative information generated or collected in connection with operation of the Services.
“Services” means Company’s software-as-a-service products, including Pre-Flight, Teams, and Atticus.
3. Information We Collect
3.1 Information You Provide
We collect information you provide directly when you:
- create an account, such as your name, business email address, organization name, title, and phone number
- subscribe to a paid plan, such as billing contact information
- submit support requests, feedback, or survey responses
- communicate with us by email or through the platform
You may choose not to provide certain information, but doing so may prevent us from providing access to some features of the Services.
3.2 Information Collected Automatically
When you access or use the Services, we automatically collect:
- device and usage information, such as IP address, browser type and version, operating system, device identifiers, access dates and times, pages visited, features used, and clickstream data
- session information, such as duration of use, navigation paths, and interaction data
- cookies and similar technologies, as described in Section 9 of this Privacy Policy
3.3 Subscriber Content and Non-Retention
As of the Effective Date, Company does not retain Subscriber Content following processing, except to the extent expressly stated in the Terms of Service or required by applicable law.
In connection with operation of the Services, Company may retain Operational Metadata, including usage metrics, response-time data, session identifiers, diagnostic information, and security records.
Subscriber Content may be transmitted to third-party AI processing providers and other service providers as necessary to provide the Services.
3.4 Payment Information
Company may use one or more designated payment processors to process subscription fees, renewals, and other authorized charges. As of the Effective Date, Company uses a designated third-party payment processor to process subscription fees and related charges.
Credit and debit card data is collected and stored directly by the applicable payment processor in accordance with that processor’s applicable terms, privacy practices, and security standards. Company does not store full card numbers, CVVs, or full card data on its own systems.
For ACH payments, bank account information is handled in accordance with applicable NACHA rules and the applicable payment processor’s bank-data handling standards.
4. Legal Basis for Processing (EEA and UK)
For individuals in the European Economic Area or United Kingdom, Company processes Personal Information on the following legal bases:
- Contract performance: providing and operating the Services, processing payments, and sending service-related communications
- Legitimate interests: service improvement, analytics, security, fraud prevention, and certain business operations
- Legal obligation: compliance with applicable law, regulation, court order, or governmental request
- Consent: where required for marketing communications or other activities that rely on consent
5. How We Use Personal Information
We use the information we collect to:
- provide, operate, maintain, and secure the Services
- process payments and manage subscriptions
- send service notifications, billing confirmations, renewal notices, and account communications

- improve, analyze, and develop the Services using aggregated, anonymized, or de-identified data derived from Operational Metadata

As of the Effective Date, Company does not use Subscriber Content to train, fine-tune, or improve any artificial intelligence or machine learning model operated by Company.
Company does not authorize third parties to use Subscriber Content submitted through the Services to train, fine-tune, or improve artificial intelligence or machine learning models on Company’s behalf, except as expressly agreed in writing by Company and Subscriber.
6. How We Share Personal Information
6.1 Service Providers
We share Personal Information with third-party vendors who perform services on our behalf, including payment processing, cloud infrastructure and hosting, database services, email delivery, network security, and AI processing. Service providers are contractually bound to use Personal Information only to perform services on our behalf or as otherwise permitted by applicable law.
6.2 AI Processing Providers
Subscriber Content submitted to the Services may be transmitted to third-party AI providers for processing as necessary to provide the Services.
If Company maintains a current list of AI processing providers, Company may make it available upon written request to [email protected].
6.3 Business Transfers
If Company is involved in a merger, acquisition, financing, due diligence process, reorganization, or sale of assets, Personal Information may be transferred as part of that transaction. We will provide notice where required by applicable law.
6.4 Legal and Regulatory Compliance
We may disclose Personal Information if required to do so by law, court order, or valid governmental request, or if we believe disclosure is necessary to protect the safety of any person, prevent fraud or illegal activity, or protect Company’s legal rights.

As of the Effective Date, Company does not retain Subscriber Content following processing, except to the extent expressly stated in the Terms of Service or required by applicable law. As a result, Subscriber Content may not be available for export, retrieval, or recovery after termination.
Company may retain Operational Metadata and other account-related information as necessary to operate the Services, comply with legal obligations, resolve disputes, and enforce agreements.
Aggregated, anonymized, or de-identified data that cannot reasonably be attributed to any individual may be retained for service improvement, analytics, security, operations, and product development.
12. International Data Transfers
Personal Information may be processed and stored on servers located in the United States and other jurisdictions where Company or its service providers operate.
If you are located in the EEA or UK, Personal Information may be transferred outside those regions. Company will implement appropriate safeguards where required by applicable law.
13. Children’s Privacy

14. High-Risk Data and HIPAA

If Company expressly agrees in writing to a separate Business Associate Agreement or other regulated-data arrangement for an eligible engagement, that arrangement will govern solely to the extent stated in the applicable written agreement.
